This Privacy Statement describes how Foxen Administration, LLC and its affiliates (collectively, “Foxen,” “we,” “us,” “our”) collect, use, and share your personal information. We understand how important your privacy is and we are fully committed to protecting it. Our goal with our Privacy Policy is to be transparent, comprehensive, and understandable. WHAT INFORMATION DO WE COLLECT?

Foxen collects the following data for our respective products:

•   Property Damage Liability Waiver Program: Your first and last name, email address, phone number, date of birth, address.

•   Rentistry: Your first and last name, email address, phone number, date of birth, address, and your rent payment history.  

 

WHO COLLECTS YOUR INFORMATION?

Foxen Administration, LLC is the entity that provides the products and services to our customers for which we collect your personal information. Foxen Administration, LLC is a Delaware limited liability company based in the United States, and part of the Foxen family of companies.

In addition to Foxen, our customers to which we provide our services may collect your personal information. These companies may have their own privacy policies that you may also want to read.

  

HOW DO WE COLLECT YOUR INFORMATION?

We collect personal information from two main sources:  

•   Directly from you: We collect personal information directly from our interactions with you. Examples include the following:

  • Forms that we provide on our website for the purpose of registering to use our site and subscribing to our service;
  • Through our online portal for residents of our customers linked from our website;
  • Phone conversations and written communications exchanged between you and us; and
  • Documents that we collect either through postal letters and/or emails.

•   Our customers: We work with multi-family property and student housing property owners and property management companies to provide our products and services. As part of administering these products and services, our customers provide us with personal data of their residents.

In addition to receiving information from these sources, we may also receive your personal information from public records, government agencies, and devices and browsers.

 

WHY DO WE COLLECT YOUR INFORMATION?

We may use, process, or disclose your information for one or more of the following purposes:

•   Provision of products and services:

  • Establishing a record of you to provide our services to property owner/management clients
  • Processing transactions during the provision of our services
  • Communicating directly with you as part of our provision of service
  • Furnish information to a credit reporting agency as part of our Rentistry product

•   Product and service development and enhancement:

  • Tailoring our products and services to our customers
  • Processing feedback to refine and improve our products and services

•   Communications:

  • Updating our institutional customers about our products and services
  • Sending residents updates, reminders, requests, or other relevant communications
  • Addressing questions, concerns, or feedback from our customers or residents

•   Marketing:

  • Sending relevant offers or promotions related to current, new, or enhancements of products and services
  • Sending educational content of our products and services

•   Security:

  • Monitoring and analyzing transactions to prevent fraudulent activities
  • Prevent security breaches or malicious activities

•   Legal and regulatory obligations:

  • Use your information to the extent necessary to comply with applicable laws, regulations, and other legal mandates
  • Perform our contractual obligations with customers, vendors, and other business partners
  • Comply with applicable record keeping requirements
  • Litigate, mediate, or otherwise resolve legal disputes and claims
  • Provide information to external parties for reports, audits, and inspections

WITH WHOM DO WE SHARE YOUR INFORMATION?

To carry out our business purposes, we may share your personal information with third parties. When we share your personal data with third parties, we generally require that the other parties keep your information confidential and secure, and that they use your information only to the extent necessary to carry out their services. Foxen may share your information with the following individuals or entities:

  • Foxen’s affiliates
  • Foxen’s business partners that are engaged to provide Property Damage Liability Waiver-related products and services such as insurance brokers, insurance companies, and claims adjusters
  • Foxen’s suppliers, vendors, subcontractors, and other business partners that provide solutions to support our operations such as IT/software solutions, HR solutions, project management tools, and compliance products
  • Credit reporting agencies
  • Law enforcement, government agencies, and other legal or regulatory authorities to comply with laws, regulations, court orders, and other legal requests
  • Any other individuals or entities that you consent for us to share your personal information

 

HOW LONG DO WE KEEP YOUR INFORMATION AND WHAT HAPPENS TO YOUR INFORMATION WHEN THEY ARE NO LONGER RETAINED?

We will generally retain your information only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, regulatory, tax, accounting, or reporting requirements. The specific retention period of your information varies based on the nature of the information and the purposes for which it was collected. Factors that may influence the retention period include our contractual obligations to customers and business partners, and the operational needs of our business. We will regularly review applicable laws and regulations so that our retention policies are up to date.  

After the retention period ends for your information, we will take steps to destroy your information consistent with applicable laws and regulations. We will implement measures that prevent the information from being read, retrieved, or reconstructed such as shredding or pulverizing physical records of your information and deleting electronic records of your information. In some cases, we may anonymize your personal information so that it can be no longer associated with you. We will regularly review our data disposal methods to adhere to applicable laws and regulations, and best business practices to ensure the protection of your information.

 

HOW DO WE PROTECT YOUR INFORMATION?

Foxen is dedicated to keeping your information safe and secure.  We use a combination of technical, administrative, and physical controls to protect the confidentiality, integrity, and availability of your information. Some of the ways we achieve this include:

•   Data Encryption: When we transmit your information between devices and servers, we convert your information into a format that can only be read or processed after it’s been decrypted.

•   Secure Infrastructure: We secure our network so that it’s protected against potential breaches that give unauthorized people and entities from gaining access to your information. We achieve this in a number of ways such as:

  • limiting access to your information to a restricted number of employees that only access it for business needs
  • requiring multiple levels of authentication for individuals to access your information
  • regularly monitoring network traffic for unusual activities
  • setting strong parameters for passwords of individuals accessing your information

•   Regular Security Audits: We continuously monitor and test our systems for potential vulnerabilities. We engage third-party experts to conduct unbiased security assessments and penetration tests to stay a step ahead of potential threats.

•   Addressing Third-Party Risks: When we work with third-party vendors and business partners with whom we share your information, we implement measures to minimize the vulnerabilities to your information. Examples may include incorporating language in our agreements with third parties to help protect our confidential information and restricting the scope of shared data.  

•   Incident Response Plan: No data transmission or storage can be 100% secure. So if we do have a breach, we have a plan that will

  • promptly assess the nature of the security event and determine the categories and quantify of information affected;
  • contain and control the incident to prevent further damage, loss, and/or misuse of the information affected;
  • minimize potential damage to the information affected; and
  • review and assess the effectiveness of the response and identify lessons to mitigate or prevent future incidents.

•   Continuous Updates and Training: Technology threats evolve so we must evolve as well. We continuously invest in and update our security infrastructure and practices to address new challenges. We also provide education and training to our employees and stakeholders so that your information continues to receive the highest levels of protection.

 

WHAT RIGHTS DO YOU HAVE REGARDING THE INFORMATION WE COLLECT?

At Foxen, we are fully committed to providing you with an opportunity to exercise all of your rights related to your personal information under applicable law. Different laws and regulations stipulate the types of rights you have which may include the following:

 •   Right to know and access: You have a right to full transparency regarding the information we collect about you. This includes details about the type of information we collect, where we collect it from, how we collect it, how we use it, and for what purpose we collect it.

•   Right to correct: You have the right to ensure that the information we use is accurate, and to correct us if it is not.

•   Right to delete or restrict: Under certain conditions, you can request that we delete the information we have about you, or, if not deleted, restrict the use of your information even if we continue to retain the information.

•   Right to data portability: You may request a copy of your information that we possess in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.

•   Right to opt out: Under certain conditions, you may inform us that you do not want us to use your information in certain activities such as the following:

  • Promotional or marketing activities: if you no longer wish to receive promotional emails from us, you have the right to opt out at any time. If you elect to opt out, we will promptly update our records to ensure that you do not receive additional promotional or marketing materials. Please note that there may be a period of time while we process your request in which you may receive marketing or promotional materials.
  • Sharing of personal information: In some situations, you may have the right to stop us from sharing your personal information with third parties. Please note that we may deny your request if the sharing of personal information is necessary to comply with our legal obligations, exercise claims or rights, defend legal claims, or otherwise follow applicable law.
  • Tracking your personal information: In some situations, you may ask not to have your activities tracked. See the section titled “How Do We Use Cookies and Other Behavioral Advertising” for more information.
  • The sale of your personal information: If our services or business practices include the sale of your information to third parties, you have the right to opt out of such sale.
  • Profiling in furtherance of decisions that produce legal or similarly significant effects: In some situations, you can ask us to stop using your information for the purposes of automated processing to evaluate, analyze, or predict personal aspects relating to you.

•   Right to not be discriminated against for exercising your rights under applicable law: We will not discriminate against you for exercising your privacy rights. This means that we will not deny you any products or services, charge you different rates, provide you with a different level or quality of service, or suggest any of the above for exercising your rights under applicable privacy laws and regulations.

•   Right to appeal: You have the right to appeal our decision denying a request to exercise a right.

Children under the age of 16: Foxen’s website, and products and services are directed towards adults. If you are under the age of 16, you must obtain the authorization of a parent or guardian before using Foxen’s products and services. If we become aware that we collected personal information of children under age 16, we will promptly remove such information from our systems.

 

HOW DO WE USE COOKIES AND OTHER BEHAVIORAL ANALYTICAL TOOLS?

Cookies are pieces of data that are stored on your computer or other electronic devices when websites are loaded in a browser. They are used to “remember” little bits of information about your preferences for pages and visits so that they make your web experience more personal. You may be able to set your web browsers to refuse cookies or alert you when cookies are being used.

Foxen may use cookies to better understand how our site is performing and make any changes to improve user experience. Examples of how we may use cookies is to authenticate a user, deliver marketing or promotional materials that align with the user’s interests, or solicit feedback.

In addition to cookies, Foxen uses web analytics to better understand your journey across our platform.

 

WHAT CHANGES CAN WE MAKE TO THIS PRIVACY POLICY?

We may revise this Privacy Policy due to changes to our company policies, updates to applicable laws and regulations, modifications to our products and services, and suggestions from user feedback. If our changes are significant, we may notify users through different ways such as email, notice on our website, and/or direct communication.

 

CALIFORNIA CONSUMERS PRIVACY STATEMENT AND NOTICE AT COLLECTION

The information under this section is provided consistent with the California Consumer Privacy Act of 2018 (“CCPA”) and its successor, California Privacy Rights Act (“CPRA”). This section supplements the information contained in the Foxen Privacy Statement and applies solely to California consumers. Any terms defined in the CCPA and CPRA have the same meaning when used in this section.

Personal Information Collected 

Foxen collects following information for our respective product or business purpose. The information identifies, relates to, describes, references, is capable of being associated with, or could reasonably linked, directly or indirectly, with a particular consumer or device (collectively,“CCPI”).

•   Property Damage Liability Waiver Program: Your first and last name, email address, phone number, date of birth, and address.   

•   Rentistry: Your first and last name, email address, phone number, date of birth, address, and your rent payment history.

•   Foxen People Operations:

  • Identifiers and/or personal information categories listed in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)): Your first and last name, email address, phone number, date of birth, address, social security number, bank account information, education history, employment history, driver’s license number or other state ID number, drug screening results, copies of photo identification.
  • Protected classification characteristics under California or Federal law: Race/ethnic identification, gender, disability status, marital status, smoker status.
  • Data Retention: Foxen retains the personal information collected, including sensitive personal information, it collects about California consumers for only as long as it is required to provide consumers with the goods or services they request and in accordance with applicable law.

Purposes for Which Categories of Personal Information is Collected: We collect your personal information to support our business operations; manage, improve, and develop our business; and comply with applicable laws and regulations. Categories of Personal Information Foxen has Sold Over the Preceding 12 Months: Foxen has not sold nor do we currently sell your personal information to anyone.

Notice of Financial Incentive: Foxen does not offer financial incentives to consumers to provide personal information.

Your California Privacy Rights:

•   Right to Know and Access: You have the right to request Foxen to provide you with the following information, covering the 12-months preceding the date your request is submitted.

  • The categories and specific pieces of personal information collected, sold, or shared about you.
  • The categories of sources of the personal information collected about you.
  • The business or commercial purposes for collecting, selling, or sharing your personal information.
  • The categories of third parties to whom we disclosed, sold, or shared your personal information.
  • The categories of personal information we disclosed, sold, or shared about you for a business purpose.

•   Right to Correction: You have the right to request Foxen to correct inaccurate personal information collected from you. Once we receive and confirm your request, we will correct your inaccurate personal information in our records.

•   Right to Deletion: You have the right to request Foxen to delete the personal information collected from you. Once we receive your request, we will delete your personal information unless it is reasonable for Foxen to maintain your information in order to:

  • Complete the transaction for which the personal information was collected, provide a good or service you requested, take actions reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for those purposes;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act pursuant to Chapter3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code;
  • Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the business’ deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if you have provided informed consent;
  • To enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Foxen and compatible with the context in which you provided the information;
  • Comply with a legal obligation.

•   Right to Opt-Out: You have the right to request that Foxen no longer share your personal information.

•   Right to No Retaliation Following Opt-Out or Exercise of Other Rights: Foxen will not discriminate against you because you exercise any of your rights as a consumer under the CCPA/CPRA, including, but not limited to, by:

  • Denying goods or services to you;
  • Charging you difference prices or rates for goods or services, including through the discounts or other benefits or imposing penalties;
  • Providing a different level or quality of goods or services to you;
  • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services;
  • Retaliating against you if you are an employee, applicant for employment, or independent contractor, as defined under subparagraph (A) of paragraph (2) of subdivision (m) of Section 1798.145 of the CCPA, for exercising your rights under the CCPA.

•   Right to Limit Use and Disclosure of Sensitive Personal Information: Foxen may collect and retain “sensitive personal information” as defined under the CPRA such as social security number, driver’s license number, financial account information, and racial and ethnic descriptions. You have a right to request that your information be only used to the extent necessary to perform the services or provide goods reasonably expected by an average consumer who requests those goods or services, and as authorized by further regulations.

 

How to Exercise Your Rights under the CCPA/CPRA: To make a request to exercise your rights as set out above, you can make a request through the methods described under the section titled, HOW CAN YOU CONTACT US TO ASK QUESTIONS OR MAKE REQUESTS UNDER THIS PRIVACY POLICY? To ensure the security of your personal information and prevent fraudulent requests, we may need to collect personal information and other information such as your name, postal address, or your email address to verify your identity.
